ONCE MORE THE COURTS HAVE REVERSED THEMSELVES. IN A RECENT DECISION, THE COURT HAS DECIDED THAT BEING IN PRISON MAY ENTITLE YOU TO A MODIFICATION OR TERMINATION OF YOUR SUPPORT OBLIGATION.

We successfully convinced the Philadelphia Family Court that our client was not the alleged father and was entilted to refund of all support collected from him. Based on drug use, we convinced a Bucks County Court to award primary physical custody to a father after 4 years with the mother. Because of inadequate living arrangements, we convinced a Delaware County Court to award primary physical custody of a child to a father after 6 years with the mother. Recently, 2007, we successfully prevented the removal of children from the Philadelphia area.

I am frequently asked "Can I get back child support for my 15 year old?" The answer is probably no. Child support, like spousal support, is prospective, going into the future. The filing of a Petition/Complaint begins the time from when support may be received. Not entilted to spousal support, have you thought about APL?

Do you or the other parent want to relocate? Depending on the custody arrangement, you may need to seek Court approval. Accomadations must be made to continue the relationship with the other parent.

When you were divorced, how was your marital real estate divided? Or, was it dealt with at all? If not, you may still have your rights resolved. After divorce, the form of ownership changes and the real estate is subject to partition.

Wills

Do you have a will? Without a Will, in Pennsylvania or New Jersey, the law decides how your estate will be divided. Recently, we handled a motor vehicle claim for a young man who was crossing a higway outside of the crosswalk at night. The initial defense was that your client was wearing dark clothes and crossing outside of the crosswalk at night. We established that the tortfeasor, defendant, was not paying attention and did not see our client. Result: Settled before trial.

In 2006, we resolved a one vehicle unisured motorist claim, which invloved disputes as to fault and the amount available to be recovered by our client. During the litigation, we discovered that the insurance company had prepared the wrong Rejction of Uninsured Motorist Benfits form.

Were you pedestrian injured by a motor vehicle? Do not worry. The Supreme Court of Pennsylvania recently declared all pedestrians as full tort.

The Supreme Court of Pennsylvania has recently severely limited a person's right of recover in Uninsured and Underinsured Motorist claims. The Court upheld the "Regularly Used Non Owned Vehicle" and "Family Vehicle" exclusions. The "Family Vehicle" exclusion applies where the members of one household have their vehicles insured under different policies and/or with different insurers. You should avoid this barrier to complete compensation.

Insurance Bad Faith

We represented a lady, who had purchased disability insurance protection for several loans. After she became disabled, she presented a claim for payment of the disability insurance. Her claim was denied for several reasons, including that she was not under active care. We were retained and commenced litigation. Shortly after commencing litigation, we resolved the claim, including a n award of bad faith damages.

We represented a lady, whose diamond engagement ring was lost at home. The insurance carrier denied her claim. We were retained. After commencing litigation, we secured a settlement for our client.

Personal Injury

In a recent premises liability matter, we successfully secured a settlement for a client, who suffer a knee injury from falling debris. We were able to prove that the property owner knew that debris had fallen from thier building before the incident. We were also able to defeat any suggestion of a prior injury.

Have you recently been injured as a result of a automobile collision, premises defect or medical care or treatment? Generally, the statute of limitations in Pennsylvania is two (2) years from the date of injury. In cases of death, the two (2) year period begins on the date of death. In other cases, the two (2) year period may be extended by the "Discovery Rule." For minors, the statute is extended until two (2) years after the child has reached 18 years of age. Workers' Compensation

Did your worker's compensation benefits suddenly stop? There are several possible reasons for the stoppage. You could have failed to return documents to the carrier. Or, more likely, the carrier could have stopped your benefits. If the carrier stopped your benefits, wages or medical, without following proper procedure, it may be responsible to you for the benefits, as well as a penalty of up to 50% of the overdue benefits.

If you are presently out of work and receiving compensation payments, your employer or its insurer may request that you complete a Employment Verification. If you fail to return the verification timely, your benefits may be suspended. If you miss an employer's requested medical examination, your benefits may be suspended.
